2. Service Agreement
All home renovation services are governed by a formal written contract or agreement that outlines project scope, specifications, timelines, payment terms, warranties, and responsibilities of both parties. No oral representations or modifications are binding unless documented in writing and signed by authorized representatives of both parties.
3. Payment Terms
Payment schedules are outlined in individual project contracts. Typical arrangements include:
- Deposit: 25-50% due upon contract signing to secure scheduling and order materials
- Progress payments: Due at predetermined project milestones (typically 25-35% each)
- Final payment: Balance due upon substantial completion and satisfactory walkthrough
- Late payments may incur interest charges of 1.5% per month on outstanding balances
4. Project Changes & Modifications
Change requests must be submitted in writing and approved by both parties before implementation. Approved changes may affect project timeline, cost, and resource allocation. Change orders will document modifications, associated costs, timeline impacts, and require client signature before work proceeds. We strive to accommodate reasonable change requests while maintaining project integrity.
5. Cancellation & Refund Policy
Cancellations must be submitted in writing. Refund eligibility depends on cancellation timing and work completed:
- Within 72 hours of contract signing: Full refund minus 5% administrative fee
- After work begins: Refund of unused materials and prorated labor costs only
- After substantial completion: No refund; warranty provisions apply instead
- Client-initiated cancellations for convenience may incur additional charges
6. Warranty Provisions
All completed work carries warranty coverage as specified in project contracts and warranty documents. Standard warranties cover defects in workmanship and materials under normal use conditions. Warranties do not cover damage caused by misuse, neglect, unauthorized modifications, normal wear and tear, or acts of nature. Warranty claims must be reported promptly and will be addressed according to established procedures.
7. Liability & Indemnification
Elegant Living Styles maintains comprehensive liability insurance as described elsewhere. Our total liability for any claim arising from services shall not exceed the total amount paid by the client for the specific project giving rise to the claim. Client agrees to indemnify and hold harmless Elegant Living Styles from claims arising from client-provided materials, decisions outside our control, or unauthorized modifications.
8. Property Access & Safety
Client must provide reasonable access to work areas during scheduled work hours. Client is responsible for securing valuables, pets, and sensitive areas prior to work commencement. Both parties share responsibility for maintaining safe worksite conditions. Children and pets should be kept away from active construction zones for safety reasons.
9. Intellectual Property
All designs, plans, drawings, specifications, and creative materials developed by Elegant Living Styles remain our intellectual property until full payment is received. Upon full payment, clients receive limited license to use delivered materials for their property purposes. Resale, distribution, or commercial use of our proprietary materials without permission is prohibited.
10. Dispute Resolution
In the event of disputes arising from these terms or service agreements, both parties agree to attempt good-faith negotiation before pursuing formal remedies. If negotiation fails, disputes shall be resolved through binding arbitration in Snohomish County, Washington, according to American Arbitration Association rules. Each party bears their own attorney fees unless arbitrator determines otherwise.
11. Governing Law
These Terms and Conditions and all related agreements shall be governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any legal proceedings shall be brought exclusively in state or federal courts located in Snohomish County, Washington.
12. Modifications to Terms
Elegant Living Styles reserves the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting to our website. Continued use of our services or website after changes constitutes acceptance of modified terms. We recommend reviewing terms periodically.
